Customers’ Suit Against First USA Dismissed

First USA Bank won dismissal of a lawsuit by customers who claimed the company wrongfully charged late fees and raised interest rates on their credit-card accounts. Customers who filed the suit in April in federal court in Dallas alleged that the Bank One Corp. unit took too long to post their credit-card payments, allowing the company to charge late fees of $25 to $35. After repeated late-payment charges, the company raises customers’ interest rates, the plaintiffs said.Attorneys for the customers couldn’t be reached for comment. A Bank One spokesman said the company doesn’t comment on legal matters. Chicago-based Bank One shares closed off $1.19 at $35.25 on the NYSE.
