Newmont Mining and its British ally were back before a Wilmington, Del., judge in an attempt to to crush a hostile takeover attempt led by T. Boone Pickens Jr. The hearing came one day after Newmont won a federal court order in California blocking the attempted takeover by the Pickens-led investor group, Ivanhoe Partners. At issue in Delaware before Chancery Court Vice Chancellor Jack B. Jacobs was whether Consolidated Gold Fields PLC, Newmont’s biggest shareholder, could retain the 15.8 million Newmont shares it scooped up in a “market sweep” last week to thwart Pickens’ hostile bid.
